Order
The 4th October,2002
No.S.O.81/C.A.2/1899/S.9/2002.-In exercise of the powers conferred by clause (a) of Sub-section (1) of Section 9 of the Indian Stamp Act, 1899 (Central Act 2 of 1899) and all other powers enabling him in this behalf, and in suppression of Haryana Government, Revenue Department, Order No.S.O.132/CA2/1899/S.9/2000, dated the 13th November,2000, the Governor of Haryana hereby remits the duty chargeable under the said Act in respect of an instrument of sale or lease of built-up space in Government approved private Software Technology Park of Information Technology Park or a Cyber City where such sale or lease is for establishing an Information Technology Industry as detailed in the Schedule annexed to this order, at the following rates:-
(i) From the date of publication of order in the official gazette to 31st December,2003 90 percentum
(ii) From Ist January, 2004 to 30th June,2005 75 percentum
(iii) From Ist July,2005 to 31st December,2006 60 percentum
(iv) From Ist January, 2007 to 30th June,2008 45 percentum
The said remission would also be available for sale of lease of land in industrial estates developed by the State or the Public Sector Organizations where such sale or lease is for establishing an Information Technology Industry.
The said remission would further be available to an organization in private or public sector, which purchases land for setting up a Software technology park or an Information Technology Park or a Cyber City and for which the required approval has been obtained from the Department of Town and Country Planning, Haryana with the condition that he will pass on this concession to the Information Technology units, which purchase land in the park/city so developed, for setting up of Information Technology units, subject to necessary safeguards, such as bank guarantee for suitable period of time, so as to check misuse of the above incentive. In case, where a party has not obtained the approval of Town and Country Planning Department, it will pay the full amount of stamp duty which will be refunded to it after it has obtained the requisite permission of Town and Country Planning Department. The units, which take land or built up space on lease/purchase basis in such Park/City would also be entitled to this remission for the exemption as mentioned above. However, this remission would be limited to the first transactions only.
