 NOTIFICATON

Dated, the 3rd October, 2003

No. 2/1/22-IIB-II-99 In partial modification of Haryana Government Notification No. 2/1/22-IIB-II-99 , dated 11th November, 1999 and with a view to facilitating rapid industrialization in the State, the Governor of Haryana is pleased to make the following amendments/insertions in the Estate Management Procedure:-

 PAYMENT TERMS

            Interest rate after offer of possession on balance amount of installment will be charged @ 11% instead of 15% and interest on the late payment of installment will be reduced from 18% to 14% per annum.

 COMPLETION OF PROJECT

              The allottee shall start construction of building within one year of offer of possession and will start commercial production within a period of three years from the date of offer of possession.  In case, the allottee is not able to start construction within one year, extension will be granted by the allotting agency for maximum period of 6 months, if the allottee is able to satisfy the agency that he could not start construction for reasons beyond his control.   Similarly, the period for commencement of production will be extended by the allotting agency for a maximum period of one year subject to the allottee satisfying the agency that he could not go into production within three years of the date of offer of possession for reasons beyond his control and the allottee took effective steps for implementation of the project.  Extension in period for commencement of commercial production beyond three years shall be granted only, if 10% of the permissible ground coverage has been achieved and effective steps have been taken by the allottee for the completion of the project.   In such cases 25% of the prescribed extension fees shall be charged.

              Second Extension of one year for completion of the project i.e. after four years from the offer of possession will be allowed in those cases where the allottee has achieved at least 20% of the permissible ground coverage and machinery has been ordered on payment of 50% of the extension fee prescribed for that area in Estate Management procedure.  Those allottees that commence commercial production in the extended period will not be allowed 20% rebate.

 BIFURCATION/FRAGMENTATION OF PLOT

              Sub Division/Bifurcation of Industrial plot of 1 acre and above shall be permitted.  Such plots will be sub-divided/bifurcated in not more than 2 plots, subject to the condition that sub-divided plots shall not be less than 500 Square Yards and bifurcation will be only for industrial purpose and there will not be more than two tenants on the original plot.

            The transferee will pay bifurcation fee equivalent to the transfer fee applicable in that area.  This will be applicable only for those fragmentation/bifurcation which have been made up to 25th September, 2003 and no bifurcation will be allowed after that date in the old Industrial Estates/ Areas, Yamunanagar, Panipat, Sonepat and Bahadurgarh developed by the department of Industries.

GENERAL EXTENSION TO I.T., INDUSTRY       

 Those allottees who were allotted plots for Information Technology units but could not implements their projects within the stipulated period up to 25th September, 2003 will be granted extension of two years for completing their projects without any extension fee.  However, the rebate of 20% will not be permissible to such allottees who implement their projects in the extended period.

 CHANGE IN PERMISSIBLE COVERED AREA (PCA)

              An allottee seeking permission to transfer the plot when his project has become unviable due to reasons beyond his control or otherwise will not be allowed to transfer unless he has achieved construction of ground coverage as under:-

            i)             0 to 5 acres                                         20%

            ii)             5 to 10 acres                                         15%

            iii)             10 acres and above                            10%
