ORDER
THE 17th OCTOBER,2002
No.16/12/2000-Env III-whereas section 21 of Air (Prevention and Control of Pollution) Act,1981 (Central Act 14 of 1981), puts restrictions on the use of certain industrial plants in the Air pollution control areas except in accordance with the procedure prescribed in this regard under the said provisions;
And whereas it is necessary to follow the procedure prescribed by the State Government in this regard for making the necessary inquiry into the applications for issue of consent by the State Pollution Control Board;
And whereas as per Haryana Government Environment Department order No.16/12/2000-Environment III dated 14.07.2000, exemption was given to Information Technology Industries from the consent management as required under provisions of Section 21 of Air. (Prevention and Control of Pollution) Act, 1981 except those units having forging process and units using power-generating sets of more than 10 KVA capacity. Such Information Technology Units will provide stack as prescribed by Haryana State Pollution Control Board.
And whereas while amending Information Technology Policy 2000"IT Enabled Services" was included with in the definition/scope of IT industries in a new sub head titled "IT Enabled Services", incorporating the following form category (M) in Annexure-2 titled, "Categories of Industries in the scope/definition of information technology industry of the IT Policy 2000.
IT Enabled Services
IT Enabled services are business and services, the end products/services of which are:
Delivered outside India.
Delivered over communication networks, and
Either externally contracted (out-sourced) or provided by a remote subsidiary of the same company (out-located).
Note:
Services, which would not be included, are:
Remote production/manufacturing units
The Corporate offices of companies or their local branches
Virtual business on Internet
Following services, which meet the above criteria, would be included:
xvi) Back-office Operations
xvii) Call Centres
xviii) Content Development or Animation
xix) Data Processing
xx) Engineering and Design
xxi) Geographic Information System Services
xxii) Human Resource Services
xxiii) Insurance Claim Processing
xxiv) Legal Database
xxv) Medical Transcription
xxvi) Payroll
xxvii) Remote Maintenance
xxviii) Revenue Accounting
xxix) Supports Centres and
xxx) Web-site Services
And whereas while issuing the amended Information Technology Policy 2000, it has been observed that Information Technology Enabled Services, detailed above, are not causing any air pollution and thereby deserves exemption from the provisions of AIR (Prevention and Control of Pollution) Act, 1981 (Central Act 14 of 1981) except those Information Technology Enabled Services having power generation sets and forging process;
And whereas the State Government is of the opinion that it is necessary and expedient to make an amendment in the Haryana Government, Environment Department order No.16/12/2000-Environment III dated 14.07.2000 for incorporating the Information Technology Enabled Services.
Now, therefore, in the exercise of powers conferred by clause (b) of sub-section (1) of section 18 of Air (Prevention and Control of Pollution) Act, 1981 and all other powers enabling him in this behalf, the Governor of Haryana makes the following amendment in the Haryana Government, Environment Department order No.16/12/2000-Environment III dated 14.07.2000 namely:-

In the Haryana Government, Environment Department order No.16/12/2000-Environment III dated 14.07.2000:
1. In Para 5 Line-1 after the word industries the
word Information Technology Enabled Services as detailed above, be
incorporated.
2. In Para 5 line 7 after the word units, the word Information Technology Services as detailed above be incorporated.
